5. Subscription Plans & Payments

5.1 Subscription Tiers

We offer multiple subscription tiers (Basic, Spark, Flame, SuperFlame) with varying features and pricing. Details of each plan are available on our pricing page.

5.2 Billing

• Subscriptions are billed on a monthly or annual basis, as selected during checkout
• All fees are non-refundable except as required by law
• You authorize us to charge your payment method for all fees incurred
• Prices are subject to change with 30 days' notice

5.3 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation will be effective at the end of your current billing period. No refunds will be provided for partial subscription periods.

6. User Content & Privacy

6.1 Palm Images

By uploading palm images to our Services, you grant us a limited, non-exclusive license to use, store, and process these images solely for the purpose of providing palmistry analysis services to you.

6.2 Birth Details

Your birth details (date, time, place) are stored securely and used exclusively to generate personalized astrological insights. We do not share this information with third parties except as described in our Privacy Policy.

6.3 Questions & Communications

All questions submitted and responses provided are stored for quality assurance and service improvement purposes. Your communications with our astrologers are confidential and will not be shared publicly.

7. Prohibited Conduct

You agree not to:

• Use our Services for any illegal purpose or in violation of any laws
• Upload images of someone else without their consent
• Impersonate any person or entity
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt the Services or servers
• Use automated systems (bots, scrapers) to access the Services
• Resell or redistribute our Services without permission
• Submit false or misleading information

8. Intellectual Property

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of Whispering Palms and are protected by international copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, modify, distribute, or create derivative works based on our content without our express written permission.

ASTROLOGY AND PALMISTRY ARE INTERPRETIVE ARTS. WE MAKE NO GUARANTEES ABOUT THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY READINGS OR PREDICTIONS PROVIDED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHISPERING PALMS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Services
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Services
• Any decisions made based on our astrological or palmistry readings

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

11. Indemnification

You agree to indemnify, defend, and hold harmless Whispering Palms and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your violation of any third-party rights.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the Indian Arbitration and Conciliation Act, 1996.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
